VAT Refund Deadline in the UAE: Act Before 31 Dec 2026 Today

VAT refund deadline in the UAE: Claim Old Credits by 31 December

The VAT refund deadline in the UAE is now real, and for older balances, it falls on 31 December 2026. If your business has carried a VAT credit on its Federal Tax Authority (FTA) account for years, that money must be refunded or put to use before the end of this year, or the right to it lapses.

At Exactitude Business Services, this is part of our Corporate Tax and VAT services in the UAE, where we prepare refund claims and the schedules behind them. This guide does not cover VAT refunds in general. It focuses on one question: which old credits expire, and what you can still do about them in the weeks left.

This guide is written by our tax and accounting team, drawing on 14+ years in the UAE. Every rule below comes from official sources: the VAT Decree-Law and the Tax Procedures Decree-Law as consolidated by the Ministry of Finance (MoF) and published by the FTA, the FTA’s Public Clarification VATP046 (September 2026), the FTA refund service card and the EmaraTax VAT311 user manual. Where a point is our own practice, we say so.

UAE VAT refund deadline 31 December 2026 at a glance

The VAT Refund Deadline in the UAE at a Glance

  • From 1 January 2026, excess recoverable VAT can only be carried forward, used or refunded for five years from the end of the tax period in which it arose.
  • Credits whose five-year period has already lapsed get a one-time transitional window. You can apply to refund them, or to use them against tax or penalties, until 31 December 2026.
  • After the deadline, a credit that was not claimed or used is lost. It cannot be refunded and cannot settle any future VAT.
  • Credits from 2022 onwards follow a rolling five-year clock, so a new deadline arrives every tax period.

If your business registered for VAT between 2018 and 2021 and has ever been in a refundable position, check your account now.

What Changed on 1 January 2026

Two laws changed together, both effective 1 January 2026.

The new five-year limit in the VAT law

Federal Decree-Law No. 16 of 2025 amended Article 74 of the VAT Decree-Law (Federal Decree-Law No. 8 of 2017). Before the change, excess recoverable tax that was not refunded simply carried forward to later tax periods, with no end date.

The amended Article 74(3) now says the excess is carried forward “for a period not exceeding (5) five years from the end of the Tax Period in which the excess arose”. If no refund request is made and the credit is not used to settle tax in that time, “the right to claim such excess shall lapse and may not be used to settle any Tax liabilities”.

The MoF announced this on 3 December 2025. It said the aim is to prevent the build-up of old balances and to strengthen financial certainty.

The matching rule in the Tax Procedures Law

Federal Decree-Law No. 17 of 2025 amended the Tax Procedures Law (Federal Decree-Law No. 28 of 2022). Article 38(2) now requires submitting any refund application for a credit balance within five years from the end of the relevant tax period. Article 38(6) says that if the application is late, “the right to claim a refund of the excess Tax paid or the credit balance shall lapse”.

Article 9(3) adds a limit on the FTA’s side. The FTA can only allocate a credit balance to settle other tax or liabilities within the same five-year period.

The transitional window that ends on 31 December 2026

Without a transition, every balance older than five years would have expired overnight on 1 January 2026. Article 3 of Federal Decree-Law No. 17 of 2025 prevents that.

It lets a taxpayer whose five-year period has lapsed apply to refund the credit balance, or to use it to pay tax liabilities or administrative penalties. The condition: the request must be submitted within one year of the law’s effective date of 1 January 2026. That window closes on 31 December 2026.

The same article gives two related protections:

  • The FTA may audit or assess a refund application made in this window for up to two years after it is submitted.
  • You may file a voluntary disclosure about that refund application within two years of submitting it, as long as the FTA has not already decided on it.

Which VAT Credit Balances Are Caught by the Deadline?

VAT started in the UAE on 1 January 2018, so the oldest credits are almost nine years old.

Credits from 2018, 2019 and 2020

Any credit from a tax period ending on or before 31 December 2020 had passed its five-year mark by 1 January 2026. These balances depend entirely on the transitional window. Once 31 December 2026 passes, they are gone.

What about 2021 credits?

This is where care is needed. A credit from the tax period ending 31 March 2021, for example, reached its five-year mark on 31 March 2026.

The transitional article applies to credits whose five-year period “has lapsed” and asks for the request within one year of 1 January 2026. Several advisory firms read it as also covering balances whose five-year period ends during 2026. Our practical advice is simple: treat every credit from a tax period ending in 2021 as due by 31 December 2026 at the latest, and do not wait for its own anniversary to pass.

Credits from 2022 onwards: the rolling 5-year VAT refund rule

From 2022 onwards, there is no single deadline. Each tax period has its own. The FTA’s own example in VATP046 shows a tax period ending 31 January 2026 with a credit: that credit can be used or refunded until 31 January 2031, and is forfeited after that.

So a credit from the quarter ending 31 March 2022 has until 31 March 2027. This is why we suggest an ageing schedule for credits, not a one-off clean-up (more on that below).

Why Businesses Still Have Old VAT Credits

Old balances usually come from one of these situations:

  • Start-up years. A new company buys equipment, fit-out and stock before it sells much. Input VAT exceeds output VAT for several quarters.
  • Exporters and zero-rated suppliers. Businesses that mostly make zero-rated supplies often sit in a refundable position for long stretches.
  • Overpayments. A return was paid twice, or a payment was made against the wrong period.
  • Voluntary disclosures. A correction reduced tax already paid and created a credit.
  • “We’ll use it later” thinking. Many owners chose to keep the credit on account to offset future VAT. Under the old rules, that was fine. Under the new rules, the clock decides.
  • Dormant or restructured companies. A business that slowed down, changed owners or changed accountants may not know the balance exists.

Refund or Use? Your Two Options Before 31 December 2026

The transitional article gives two choices for an old credit balance.

Option 1: Apply for a refund

You submit a VAT refund request (VAT311) on EmaraTax for the old periods. The FTA’s FAQ confirms one VAT311 application can cover one or more tax periods in which you were in a refundable position.

A refund suits businesses that do not expect enough VAT payable in the coming months to absorb the credit. It also suits companies that are winding down, deregistering or changing structure.

Option 2: Use the credit to settle tax or penalties

The law also allows the old balance to be used to pay tax liabilities or administrative penalties. Note the wording: this is also a request that must be submitted within the window, not something that happens on its own after the deadline.

This option can suit a business that will have VAT payable soon. But be careful with timing. A VAT return for the last quarter of 2026 is normally due within 28 days after the period ends, which falls in January 2027, after the window has closed. Do not rely on a future return to absorb a credit from the transitional period. Request before 31 December 2026.

Whichever you choose, the FTA first offsets the amount against any non-disputed tax or penalties you owe, under Article 39(1) of the Tax Procedures Law. Only the remainder is refunded.

How to Check Your VAT Credit Balance on EmaraTax

The first step is knowing what you have. On EmaraTax, the VAT311 refund form shows the details of your liabilities, such as late registration and administrative penalties, and the “Excess Refundable VAT Amount” for each transaction type. The amount you request cannot be more than that figure.

Before opening the form, we recommend matching three things:

  • The FTA account balance shown on EmaraTax.
  • Your VAT returns, period by period, to see which return created each credit.
  • Your own ledger, especially the VAT control account, to confirm the books agree with the FTA.

If the three do not match, find out why before you claim. Differences often come from payments allocated to the wrong period, penalties you did not know about, or disclosures that changed old returns. Our accounting and bookkeeping team often handles this reconciliation as part of a clean-up of older years.

Step by Step: Filing a VAT311 Refund Before the Deadline

The FTA service card for refunds lists four steps, and the EmaraTax VAT311 manual fills in the detail.

  1. Log in to EmaraTax and open the taxable person’s account.
  2. Open the VAT tab and select VAT311 (refund request).
  3. Read and accept the instructions, then start a new refund request.
  4. Check the pre-filled details. Bank details come from your registration data. The manual warns that incorrect bank details may lead to payment failure, so update them first if needed.
  5. Enter the amount you want refunded, which must be equal to or less than the excess refundable amount shown.
  6. Upload the supporting documents (see the list below).
  7. Review, declare, and submit, then note the application number. You can track the request from the VAT311 tile.

The FTA estimates about 10 minutes to submit the form. The real work is the preparation.

Documents to Prepare for a VAT Credit Balance Refund

For VAT311 requests, the FTA service card (last updated 19 August 2026) asks for:

  • An output and input tax report for the periods claimed.
  • Tax invoices and supporting documents behind the input tax.

For a refund of extra payments, it asks for:

  • Proof of payment.
  • A bank IBAN letter.

For old periods, the hardest part is often finding the invoices. Suppliers close, staff leave and earlier accountants keep files. Start gathering early.

From our practice, a short covering note helps. It explains where the credit came from and links each figure to the return that created it.

What happens after you submit a VAT311 refund request

What Happens After You Submit

According to the FTA service card, a complete refund application is processed within 25 business days from receipt. If the request needs more investigation by the audit team, it can take 55 working days from the date you provide all the information requested.

If the application is incomplete, the FTA will ask for more documents. After you send them, it may take a further 25 business days to respond.

  • The FTA decides each claim. It may accept or reject the application, in whole or in part.
  • The FTA can hold back a refund of the remaining amount if there are other disputed tax amounts, if you are under a tax audit (subject to conditions set by the FTA board), or under a court order (Article 39(2)).
  • A claim can lead to an audit. For applications made in the transitional window, the FTA has two years from submission to complete an audit or issue an assessment.

Accuracy matters more than speed. A rushed claim with weak documents creates delay.

What Happens If You Miss the VAT Refund Deadline?

The law is clear. Under Article 74(3) of the VAT Decree-Law and Article 38(6) of the Tax Procedures Law, the right to claim the excess lapses. The credit cannot be refunded and cannot be used to settle any VAT later.

We have not seen any official extension of the 31 December 2026 date. Plan as if there will be none.

For many small and medium businesses, a few quarters of start-up input tax can add up to a meaningful sum, and a lapse is permanent.

Common Mistakes With Old VAT Credits

These are the issues we see most often:

  • Assuming the credit stays forever. That was the old rule. It ended on 1 January 2026.
  • Waiting for the next return to use it. The Q4 2026 return is normally due in January 2027, after the window closes.
  • Claiming without reconciling. If the books and the FTA account disagree, the claim invites questions.
  • Missing invoices. No invoice, no evidence. Trace them before you file.
  • Outdated bank details. A refund to a closed account fails.
  • Forgetting the rolling rule. Fixing 2018 to 2021 is not the end. Credits from 2022 begin to expire from 2027.
  • Overlooking excise tax. The Tax Procedures Law applies to all taxes the FTA administers, so a business registered for excise tax should check that account too.

A Client’s Experience Recovering Old VAT Credits

This is an illustrative composite based on the kind of cases we handle. Details have been changed and no client is identified.

“We set up our distribution company in 2019 and spent most of the first year on fit-out, a warehouse and stock. Our returns showed a refund position for several quarters, and our first accountant told us to leave the credit on account. By the time sales picked up, we had changed accountants twice.

In September, a friend mentioned the 31 December deadline. I did not know how much was sitting with the FTA, or from which years.

Exactitude started by matching our EmaraTax balance against each return and our ledger. The numbers did not agree at first. One payment had been allocated to the wrong quarter, and there was a small penalty from 2020 that we had forgotten about. They explained that the FTA would offset that penalty first, so we knew what to expect.

The hardest part was the invoices. Two suppliers from 2019 had closed. The team helped us rebuild the file from our old bank records and email archive, and wrote a short note explaining where the credit came from.

The request went in during October. What I value most is the schedule they set up afterwards, showing every credit by quarter with its own five-year date.”

How Exactitude Business Services Helps

We can support you at each stage before the VAT refund deadline:

  • Credit balance review. We match your EmaraTax account, VAT returns, and ledger, period by period.
  • Ageing schedule. We list every credit with the date it lapses, including the rolling dates from 2022 onwards.
  • Refund or use decision. We look at your expected VAT position and help you choose.
  • VAT311 preparation. We prepare the claim, the tax report, and the supporting schedules, then respond to FTA queries.
  • Clean-up of older books. Where records are incomplete, our team rebuilds the trail through our outsourced bookkeeping and accounting services.
  • Ongoing compliance. Quarterly VAT returns, e-invoicing readiness, and Corporate Tax, so credits are claimed while they are fresh.

The FTA reviews and decides every refund request. Our role is to make sure what you submit is complete, accurate, and on time.

FAQ: VAT Refund Deadline in the UAE

What is the VAT refund deadline in the UAE?

From 1 January 2026, excess recoverable VAT must be refunded or used within five years from the end of the tax period in which it arose. Credits whose five-year period has already lapsed must be claimed or used by 31 December 2026 under the transitional rule.

Which VAT credits expire on 31 December 2026?

Credits from tax periods ending on or before 31 December 2020 rely fully on the transitional window. We advise treating credits from 2021 tax periods the same way, so request them by 31 December 2026 at the latest.

Can I use an old VAT credit instead of asking for a refund?

Yes. The transitional rule lets you apply to use the balance to pay tax liabilities or administrative penalties, as long as the request is submitted by 31 December 2026.

How long does the FTA take to process a VAT refund?

The FTA service card gives 25 business days for a complete application. If audit needs to investigate further, it can take 55 working days after you provide all the requested information.

Can one VAT311 request cover several tax periods?

Yes. The FTA confirms one VAT311 application can cover one or more tax periods in which you were in a refundable position.

What happens to a VAT credit after five years?

It lapses. It cannot be refunded and cannot be used to settle any later VAT liability.

Does the five-year rule apply to VAT credits from 2022 onwards?

Yes, on a rolling basis. Each credit has its own deadline five years after the end of the tax period in which it arose. For example, a credit from the quarter ending 31 March 2022 lapses after 31 March 2027.

Can Exactitude submit the refund request for my company?

Yes. We review the balance, prepare the documents, and submit the VAT311 request on your behalf, then handle FTA queries. The FTA decides the outcome of each claim.
